{"id":9786,"date":"2021-05-19T12:39:34","date_gmt":"2021-05-19T12:39:34","guid":{"rendered":"https:\/\/xislblogs.xtreamlab.net\/slwoods\/?p=9786"},"modified":"2024-09-05T11:55:06","modified_gmt":"2024-09-05T11:55:06","slug":"track-track-partner-sent-84000-nuisance-emails","status":"publish","type":"post","link":"https:\/\/www.slwoods.co.uk\/?p=9786","title":{"rendered":"Track &amp; trace &#8216;partner&#8217; sent 84,000 nuisance emails"},"content":{"rendered":"\r\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-9796\" src=\"http:\/\/xislblogs.xtreamlab.net\/slwoods\/wp-content\/uploads\/\/sites\/23\/2021\/05\/ico_logo.png\" alt=\"ICO logo\" width=\"191\" height=\"121\" \/>The Information Commissioner&#8217;s Office (ICO) <a href=\"https:\/\/ico.org.uk\/about-the-ico\/news-and-events\/news-and-blogs\/2021\/05\/ico-takes-action-against-contact-tracing-qr-code-provider\/\">has today reported<\/a> it has fined a Hertfordshire company for sending direct marketing emails to people who provided their personal data for contact tracing purposes as part of the response to the coronavirus pandemic.<\/p>\r\n<p>St Albans-based Tested.me Ltd (TML) provides digital contact tracing services which work by offering people a QR code to scan when arriving at their destination.<\/p>\r\n<p>TML sent nearly 84,000 nuisance emails at the height of the Covid-19 pandemic between September and November last year, when businesses were using private <a href=\"https:\/\/en.wikipedia.org\/wiki\/QR_code\">QR code<\/a> providers to collect personal data to comply with government contact tracing rules.<\/p>\r\n<p>The ICO fined TML \u00a38,000 for using personal data for marketing purposes without adequate valid consent, contrary to law.<\/p>\r\n<p>The ICO has created guidelines for businesses to follow as the UK economy continues to open up. Providers should:<\/p>\r\n<ul>\r\n<li>Adopt a <a href=\"https:\/\/ico.org.uk\/for-organisations\/guide-to-data-protection\/guide-to-the-general-data-protection-regulation-gdpr\/accountability-and-governance\/data-protection-by-design-and-default\/\">data protection by design<\/a> approach (DPBD) from the start when they develop new products;<\/li>\r\n<li>Make privacy policies clear and simple so that people understand how their information will be handled;<\/li>\r\n<li>Not keep any personal data they have collected for more than 21 days &#8211; in line with regulations brought in last year for the collection of information for contact tracing;<\/li>\r\n<li>Not use the personal data for marketing or any other purpose;<\/li>\r\n<li>Keep up to date with the <a href=\"https:\/\/ico.org.uk\/global\/data-protection-and-coronavirus-information-hub\/\">ICO\u2019s online guidance<\/a>.<\/li>\r\n<\/ul>\r\n","protected":false},"excerpt":{"rendered":"<p>The Information Commissioner&#8217;s Office (ICO) has today reported it has fined a Hertfordshire company for sending direct marketing emails to people who provided their personal data for contact tracing purposes as part of the response to the coronavirus pandemic.
