  • Court interpreting fiasco rumbles on

    image of scales of justiceThe Capita/ALS court interpreting fiasco (posts passim) is a story that seems set to run for some time yet.

    The crossbench (i.e. independent) peer Baroness Coussins, who is also a Vice-President of the Chartered Institute of Linguists, has tabled an oral question for the government in tomorrow’s House of Lords business.

    Her oral question is:

    Baroness Coussins to ask Her Majesty’s Government what quality criteria they are using to assess the performance of Capita in delivering interpreting services to the criminal justice system.

    Many of us either in or associated to the language and legal professions, as well as those interested in the administration of justice will await the Government’s answer with interest.

  • Complex Text Layout in LibreOffice

    ODF file iconI’m currently translating a tender document from a North African Arabic-speaking country. Even though the source language of the translation is French, when I first opened the file in LibreOffice, my office suite of choice, I noticed that the cursor was responding back to front and realised immediately this was going to slow down my progress with the job unless it was sorted out.

    Fortunately, a little bit of research and a couple of configuration tweaks soon had it sorted out. Firstly, Arabic, Hebrew, Hindi and Thai come under what LibreOffice describes as Complex Text Layout (CTL) languages.

    To deal with CTL languages, these first have to be enabled in LibreOffice under Tools > Options > Language Settings.

    That done, the LibreOffice Help wiki has instructions for working with CTL.

    Currently, LibreOffice supports Hindi, Thai, Hebrew, and Arabic as CTL languages.

    If you select the text flow from right to left, embedded Western text still runs from left to right. The cursor responds to the arrow keys in that Right Arrow moves it “to the text end” and Left Arrow “to the text start”.

    You can change the text writing direction directly be pressing one of the following keys:

    • Ctrl+Shift+D or Ctrl+Right Shift Key – switch to right-to-left text entry
    • Ctrl+Shift+A or Ctrl+Left Shift Key – switch to left-to-right text entry
    • The modifier-only key combinations only work when CTL support is enabled.

    Once CTL is enabled, LibreOffice also adds a couple of change text direction icons to the text formatting toolbar too.

  • Czech libraries protect and show historic documents with open source

    In August 2002 a week of heavy rains in central Europe caused serious flooding, resulting damage running to billions of euros in the Czech Republic, Austria, Germany, Slovakia, Poland, Hungary, Romania and Croatia.

    Amongst the items damaged were a large number of books in the Czech Republic’s archives and libraries. While the damaged documents were being recovered, a decision was taken to make digital copies publicly accessible.

    Joinup, the EU’s open source news website now reports that libraries in the Czech Republic are sharing and re-using a specialised open source content management system, Kramerius, to preserve historic documents and make them available online. Kramerius was developed with the support of the Library of the Academy of Sciences, the National Library (both in Prague), and the Moravian Library in Brno.

    Kramerius is intended for use for digitised library collections, monographs and periodicals. It can also be used for maps, musical scores and illustrations and to provide access to selections of documents, articles and chapters.

    In addition, Kramerius is part of a larger Czech Digital Library Project which aims to digitise the greater part of the resources of the National Library and the Moravian Library and thus to help to preserve them and make them accessible for future generations. It is hoped that over 50 million pages, or approximately 300 thousand volumes will be digitised by 2019.

    The Czech Digital Library project has a budget of CZK 20 million (about €800,000) over the next 3 years.

    As a matter of course, the Kramerius source code is also available online.

    The software itself is named after Václav Matěj Kramerius (1753–1808), who was a Czech writer, journalist and publisher. At a time when there was only a single Czech newspaper in print, Kramerius started his own paper and, following its commercial success, established a printing shop and publishing house for Czech language works. The majority of Czech language books were published by his publishing house at that time. Kramerius himself wrote about 80 books.

  • A traditional seasonal monologue

    In deference to the time of year, here’s a monologue – Christmas Day in the Workhouse – penned by George R. Sims in 1879.

    It is Christmas Day in the Workhouse,
    And the cold bare walls are bright
    With garlands of green and holly,
    And the place is a pleasant sight:
    For with clear-washed hands and faces
    In a long and hungry line
    The paupers sit at the tables,
    For this is the hour they dine.

    And the guardians and their ladies,
    Although the wind is east,
    Have come in their furs and wrappers,
    To watch their charges feast:
    To smile and be condescending,
    Put puddings on pauper plates,
    To be hosts at the workhouse banquet
    They’ve paid for – with the rates.

    Oh, the paupers are meek and lowly
    With their ‘Thank’ee kindly, mum’s’;
    So long as they fill their stomachs
    What matters it whence it comes?
    But one of the old men mutters,
    And pushes his plate aside:
    ‘Great God!’ he cries; ‘but it chokes me!
    For this is the day she died.’

    The guardians gazed in horror
    The master’s face went white;
    ‘Did a pauper refuse his pudding?’
    ‘Could their ears believe aright?’
    Then the ladies clutched their husbands,
    Thinking the man might die
    Struck by a bolt, or something,
    By the outraged One on high.

    But the pauper sat for a moment,
    Then rose ‘mid a silence grim,
    For the others has ceased to chatter,
    And trembled every limb.
    He looked at the guardian’s ladies,
    Then. eyeing their lords, he said,
    ‘I eat not the food of villains
    Whose hands are foul and red:

    ‘Whose victims cry for vengeance
    From their dank, unhallowed graves.’
    ‘He’s drunk!’ said the workhouse master.
    ‘Or else he’s mad, and raves.’
    ‘Not drunk or mad,’ cried the pauper,
    ‘But only a hunted beast,
    Who, torn by the hounds and mangled,
    Declines the vulture’s feast.

    I care not a curse for the guardians,
    And I won’t be dragged away.
    Just let me have the fit out,
    It’s only Christmas Day
    That the black past comes to goad me,
    And prey my burning brain;
    I’ll tell you the rest in a whisper, –
    I swear I won’t shout again.

    ‘Keep your hands off me, curse you!
    Hear me right out to the end.
    You come here to see how the paupers
    The season of Christmas spend.
    You come here to watch us feeding,
    As they watch the captured beast.
    Hear why a penniless pauper
    Spits on your paltry feast.

    ‘Do you think I will take your bounty,
    And let you smile and think
    You’re doing a noble action
    With the parish’s meat and drink?
    Where is my wife, you traitors –
    The poor old wife you slew?
    Yes, by the God above us
    My Nance was killed by you!

    ‘Last winter my wife lay dying,
    Starved in a filthy den;
    I had never been to the parish, –
    I came to the parish then.
    I swallowed my pride in coming,
    For, ere the ruin came,
    I held up my head as a trader,
    And I bore a spotless name.

    ‘I came to the parish, craving
    Bread for a starving wife,
    Bread for a woman who’d loved me
    Through fifty years of my life;
    And what do you think they told me,
    Mocking my awful grief?
    That “the House” was open to us,
    But they wouldn’t give “out relief”.

    I slunk to the filthy alley –
    ‘Twas a cold, raw Christmas eve –
    And the bakers’ shops were open
    Tempting a man to thieve;
    But I clenched my fists together
    Holding my head awry,
    So I came home empty-handed,
    And mournfully told her why.

    Then I told her “the House” was open;
    She had heard of the ways of that,
    For her bloodless cheeks went crimson,
    And up in her rags she sat,
    Crying, “Bide the Christmas here, John,
    We’ve never had one apart;
    I think I can bear the hunger, –
    The other would break my heart.”

    ‘All through that ever I watched her,
    Holding her hand in mine,
    Praying the Lord, and weeping
    Till my lips were salt as brine.
    I asked her once if she hungered
    And as she answered “No,”
    The moon shone in at the window
    Set in a wreath of snow.

    ‘Then the room was bathed in glory,
    And I saw in my darling’s eyes
    The far-away look of wonder
    That comes when the spirit flies;
    And her lips were parched and parted,
    And her reason came and went,
    For she raved of her home in Devon,
    Where her happiest days were spent.

    ‘And the accents, long forgotten,
    Came back to the tongue once more,
    For she talked like the country lassie
    I woo’d by the Devon shore.
    Then she rose to her feet and trembled,
    And fell on the rags and moaned,
    And, “Give me a crust – I’m famished –
    For the love of God!” she groaned.

    I rushed from the room like a madman,
    And flew to the workhouse gate,
    Crying “Food for a dying woman!”
    And came the answer, “Too late.”
    They drove me away with curses;
    Then I fought with a dog in the street,
    And tore from the mongrel’s clutches
    A crust he was trying to eat.

    ‘Back, through the filthy by-lanes!
    Back, through the trampled slush!
    Up to the crazy garret,
    Wrapped in an awful hush.
    My heart sank down at the threshold,
    And I paused with a sudden thrill,
    For there in the silv’ry moonlight
    My Nancy lay, cold and still.

    ‘Up to the blackened ceiling
    The sunken eyes were cast –
    I knew on those lips all bloodless
    My name had been the last;
    She’d called for her absent husband –
    O God! had I but known! –
    Had called in vain and in anguish
    Had died in that den – alone.

    ‘Yes, there in a land of plenty
    Lay a loving woman dead,
    Cruelly starved and murdered
    For a loaf of parish bread.
    At yonder gate, last Christmas
    I craved for a human life.
    You, who would feast us paupers,
    What of my murdered wife!

    ‘There, get ye gone to your dinners;
    Don’t mind me in the least;
    Think of your happy paupers
    Eating your Christmas feast;
    And when you recount their blessings
    In your smug parochial way,
    Say what you did for me, too,
    Only last Christmas Day.’

  • A spam comment (or rather several) dissected

    Keeping spam comments at bay is a constant battle for regular bloggers. Today I came across an instance of where a spammer’s script for posting spam comments to blogs went completely awry and the entire contents of the script were dumped en masse in one jumbo comment, which follows (with apologies for its length!   • “An object lesson in how not to contract out a public service”

    Today the House of Commons Public Accounts Committee published its report into the Ministry of Justice’s language service contract which provides interpreters for the courts in England and Wales.

    In August 2011, the Ministry signed a four year Framework Agreement for language services with Applied Language Solutions (ALS), under which all justice sector bodies could enter contracts with ALS. It expected the Framework Agreement to be worth up to £42 million a year. In October 2011, the Ministry signed a five year contract under the Framework Agreement which went live nationally on 30 January 2012. The Ministry expected the contract to cost £18 million a year. In December 2011, after the Ministry had signed its contract with ALS, ALS was acquired by Capita.

    However, not all has gone well with the contract, to say the least (posts passim). The Committee concluded that the Ministry was not an intelligent customer in procuring language services, despite the risks posed to the administration of justice and to the Ministry’s reputation.

    The Ministry failed to undertake proper due diligence on ALS’ winning bid. It failed to heed financial and other advice that ALS was too small and would struggle to meet the Ministry’s requirements in time. The Ministry also ignored strong opposition from the interpreter community. Interpreting is a specialised service. The procurement and later implementation might have been more effective had the strongly held views expressed by experienced interpreters and trade bodies during the Ministry’s consultation been given greater weight. The contract did not include a strong enough incentive for ALS to meet the requirements of the contract right from the start. ALS was acquired by Capita just before the contract started.

    When the contract went live, Capita-ALS only met 58% of bookings and there was a sharp rise in the number of ineffective trials due to problems with interpreters. Unnecessary costs were caused to the Ministry of Justice due to the postponing of proceedings and delays which resulted in individuals being held in custody for longer periods. The Ministry was unable to quantify the additional cost to them of the failure. However, Capita has only been fined £2,200 to date for failing to meet the terms of the contract (just why does the UK continue to reward failure? Ed.).

    Capita-ALS is now fulfilling more bookings, but it is still struggling to fulfil all and the Committee concerned that it may not be doing enough to recruit interpreters or to provide incentives to interpreters. The Ministry cannot be sure that all interpreters working under the contract have the required skills, experience and character, partly because it is not yet inspecting Capita-ALS as it has the right to do under the contract. Too many courts are having to find their own interpreters, meaning that the purpose of the policy, to provide one centralised system, has not been met.

    Speaking on the publication of the report, Committee Chair Margaret Hodge MP said: “This is an object lesson in how not to contract out a public service.”

    However, the rest of the world doesn’t necessarily recognise the limitations of machine translation tools and this can have devastating effects in some instances.

    This is amply illustrated today as UPI reports that Danish police made a mistake when they used Mountain View’s language mangler on a text message while questioning a man suspected of financing terrorism.

    The suspect’s attorney says the result was a mistranslation that caused his client to suffer a breakdown following his interrogation. The man in question, an ethnic Kurd, was suspected of donating money to the Kurdistan Workers Party (PKK) through ROJ-TV, a Kurdish language station based in Copenhagen.

    The European Union classes the PKK as a terrorist organisation.

    According to the Copenhagen Post, Thorkild Høyer, the suspect’s lawyer, said the mistranslation violates a Danish law barring police from giving misleading information during questioning and also called the use of Google Translate unacceptable in legal proceedings.

    Inspector Svend Foldager of the Copenhagen Police said the incident was the only one he knows of where police have used Google Translate.

    The Google Translate version of the message in Turkish read: “I call for a meeting.” However, according to Høyer, the message was a mass invitation and part of a text-message chain without a personal sender.

    The mistranslation of the text message was subsequently discovered by an interpreter.

    ROJ-TV itself has been found guilty by a Danish court of supporting the Kurdish separatist organisation PKK and has been fined Kr. 5.2 mn. in a controversial case that took 6 years to reach a verdict. However, the station is appealing the fine and has not had its broadcasting licence revoked.

  • Milestone meeting as Justice Minister engages interpreter groups

    Helen Grant MP, the Parliamentary Under-Secretary of State and Minister for Victims and the Courts, held positive discussions on 4th December with nine organisations who united as umbrella group Professional Interpreters for Justice and whose representatives were invited to talks.

    In the meeting Helen Grant MP said that the system needs the professional interpreters’ organisations and that if all can work effectively and positively together it will be good for the running of the justice system.

    Problems with the operation of the Ministry of Justice contract awarded to Applied Language Solutions (acquired by Capita at the end of 2011) prompted a critical National Audit Office (NAO) report earlier this year. In addition, there have more recently been two parliamentary inquiries by the Public Accounts Committee and Justice Select Committee respectively, who will publish their findings in coming weeks.

    Professional Interpreters for Justice has been invited to submit ideas on how the Ministry of Justice can carry out the recommendations of the NAO report, particularly with regard to commissioning an independent evaluation of the adequacy of the new contract’s quality standards for interpreting and translation and the incentives which might attract professionally qualified members of the interpreter organisations back to court work.

    In its report the NAO highlighted that as few as 300 (13%) of the 2,300 professionally qualified interpreters on the National Register of Public Service Interpreters (NRPSI) are still working in the court; this has caused problems with both supply and quality of interpreting in courts under the new contract.

    Keith Moffitt, Chair of the Chartered Institute of Linguists, representing Professional Interpreters for Justice, says: “There’s a real risk of the legal interpreting profession collapsing and we are encouraged that the Justice Minister wants to listen and properly engage the profession in the interests of delivering justice. Our members are principled individuals who feel their professional status has been watered down by the absence of quality in this private contract. We’ll be writing to the Minister with our proposals for working groups to tackle the issues”.

    This ancient tradition’s greatest proponent has been the alleged local paper of record, the Bristol Evening Post, whose publication is now reduced to 5 days a week as sales of the dead tree edition decline; its name has likewise been truncated to the Bristol Post.

    Today the Post revealed an exclusive. Bristol has a literate cricket ground, presumably able to speak and write, as evidenced by the following Post quote:

    The ground, in Nevil Road, St Andrew’s, released a statement this morning.

    If the ground really does talk, Gloucestershire [County] CC should be very proud of it since this particular skill is far more impressive than its cricketing record. 😉

    Update: 6th November 2012: Jon Eccles has since remarked that the County Ground is “the first sports facility of any kind to pass the Turing test“.
